Terms of Service

1. Agreement

By accessing or using AddMyLegacy (“Service”), operated at http://staging.addmylegacy.com (and related brand properties including addmymark.com), you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

AddMyLegacy provides digital preservation, proof-of-upload certificates, rights verification workflows, 3D asset hosting, and licensing tools for creators, galleries, and buyers. The Service is not a law firm, patent office, or copyright registration agency.

3. Eligibility & accounts

  • You must be at least 18 years old (or the age of majority in your jurisdiction).
  • You are responsible for safeguarding your credentials and all activity under your account.
  • We may suspend or terminate accounts that violate these Terms or our Content Protection Policy.

4. Your content & authority

You retain ownership of content you upload. You represent that you have the legal right to upload, preserve, display, and license each asset, and that your rights declaration is accurate. You grant AddMyLegacy a limited license to host, process, display, and transmit your content solely to operate the Service (including generating proof certificates and technical previews).

5. Platform exhibition consent

When you create an asset, you may allow or deny use of that work in the AddMyLegacy Platform Exhibition (public browse pages, home-page featured samples, and similar in-product discovery). This setting defaults to allowed unless you turn it off at creation or later in your asset settings.

  • If allowed: you grant AddMyLegacy a non-exclusive, worldwide, royalty-free license to publicly display preview-quality representations of the asset (e.g. images, watermarked or downscaled media, interactive 3D viewer embeds), together with title, artist name, and metadata you provided, solely to operate the exhibition, promote the Service, and direct viewers to license or request access. This license does not grant buyers or the platform rights to download originals or use the work commercially unless a separate license is purchased or you approve access.
  • If denied: we will not include that asset in the Platform Exhibition, home-page random samples, or promotional exhibition placements. Private viewer links, proof certificates, and licensing flows you initiate separately are unaffected.
  • You may change this preference at any time on the asset detail page; we will remove denied works from exhibition surfaces within a reasonable period.
  • You warrant that exhibition display (when enabled) does not violate third-party rights, contracts, or confidentiality obligations.

6. Proof certificates

Certificates document platform-verified upload integrity and audit steps. They do not constitute U.S. patent grants, USPTO filings, or U.S. Copyright Office registration. Official registration remains your responsibility.

7. Licensing & payments

License terms between buyers and sellers are defined by selected templates and offer scope. AddMyLegacy may facilitate payment processing via third parties (e.g. Stripe). Fees, refunds, and chargebacks are governed by the applicable checkout terms and payment provider policies.

8. Prohibited conduct

You may not upload infringing, illegal, deceptive, or malicious content; circumvent protection systems; scrape the Service; or impersonate others. We use Content ID-style fingerprinting, duplicate detection, and strike policies described in our protection documentation.

9. Copyright complaints (DMCA)

We respond to notices of claimed infringement consistent with applicable law. Submit reports via asset report forms or contact our designated agent listed on our DMCA page. Repeat infringers may have accounts terminated.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AddMyLegacy AND ITS AFFILIATES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL.

12. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles, unless mandatory local law requires otherwise.
